Information Technology Essay James Price is an Information Technology consultant with specific expertise in website design. His consultancy is doing well, but he would really like to gain another client to ensure that he has enough work for the foreseeable future. One Saturday, at his brother Anthony’s 40th birthday celebration, James is approached by Mark Jackson, a store owner, who James has met previously at some of his brother’s other social functions. Mark explains to James that he is looking to revamp his store’s website and that he could use James’ expertise to complete the project. James expresses his interest in assisting and Mark tells James that he will email him on Monday with a proposal. On Monday morning, Mark sends James the following email: Dear James, After thinking further about your potential involvement in the website project for the store, I want to bring you on board as a consultant. The terms of the engagement are that you will provide your web design services exclusively for two weeks, starting on 1st February 2014, working onsite with me and the store manager. In terms of remuneration, you will be paid a flat fee of $35,000 with a parking spot to be provided for the time that you are onsite. It is important that if you want this work, you indicate your acceptance in writing by the end of the day. I look forward to hearing from you. Mark Jackson. An hour after the email is sent, James reads it and is happy with the terms  of the proposal. He goes to draft an email to Mark detailing his acceptance of the terms of the offer, but because of a sudden storm that has hit the area where he lives, James’ email stops working and he is unable to send the message to Mark. James then tries to call Mark to tell him that he wants the work, but Mark doesn’t answer, and James is not given the option to leave a message. As a last resort, James drafts a letter to Mark communicating his acceptance of the offer proposed. He then takes the letter, and a strategic map for the project that he quickly prepared, to the post office and posts them at 4.30pm on Monday afternoon. The letter and the map take a day to be delivered to Mark and he receives them late Tuesday afternoon. On Wednesday, Mark realises that he has offered to pay James $15,000 more than an award winning web design firm has quoted him for the job, and he doesn’t want to engage James anymore. He sends an email to James saying that because he didn’t receive James’ acceptance by the end of Monday, James has missed out on the work. Mark also states in his email that he never meant for the proposal to be real anyway because he was only trying to help out his friend Anthony by throwing James some work. James is upset upon receiving this email from Mark and calls his lawyer for advice on the situation. Question 1: Using the four step process, discuss the element of agreement required for the formation of a legally binding contract between James and Mark. STEP 1: Identify the principles or issues of law The principles of law here is that in addition to intention and consideration aspects, there should be the existence of a valid agreement between James and Mark which is required for the formation of a legally binding contract to be created. Step 2: Explain the rule(s) of law relevant to the principle/area/issue of law identified in step one with reference to authority. There are three main requirements for the formation of a legally binding contract; intention to create a legal contract, offer and acceptance  (agreement) of the terms of the contract and consideration (reference book P-60).

Giotto Bizzarrini and the Bizzarrini BZ2001 When you’re to look upon the Bizzarrini BZ-2001, you’d see that there are no bounds to the imagination of Italian car stylists. The BZ-2001 is the work of Giotto Bizzarrini whose portfolio includes many past exotic cars. Right now, the BZ-2001 rides on the tubular chassis of a Ferrari Testarossa, and is powered by the Ferrari’s 380-horsepower flat-12-cylinder engine. But true to past Bizzarrini designs, plans are afoot to switch to American small-block V-8 power, and to discard the Ferrari’s frame for a chassis built solely of carbon fiber. With more power and less weight than the car has now, performance should be phenomenal. Many people might think that this is an all-Italian automobile, but it’s not. It was first started when Berry Watkins, who is a resident of California, sketched a few crude line drawings of what this dream car could look like. He then showed these drawings to Ing. Giotto Bizzarrini at the Pebble Beach Concours D'Elegance event. At this event, Berry Watkins was displaying his Scaglietti Berlinetta Corvette, which was considered by many that attended to be one of the most beautiful Italian bodied sports cars at Pebble Beach that year. Ing. Giotto Bizzarrini was very impressed with Berry’s work. Giotto Bizzarrini and Mr. Watkins exchanged ideas about what a future sports car or super car would look like. It was evident that Giotto Bizzarrini was very interested in the ideas Mr. Watkins offered. While all of the sketches and drawing were being exchanged, an agreement was signed in May of 1991 between Giotto and Giuseppe Bizzarrini and Mr. Watkins whereby the concept automobile would be the responsibility of Bizzarrini, and the construction, finance and development would be the responsibility of Mr. Watkins. In April of 1990, Luis Romo was elected to be the BZ-2001 project manager. Luis had been the Project Manager for the Dodge Viper Prototype at Metal Crafters. He was also on the Mazda Miata design team and was the Project Manager for the Plymouth Speedster and many, many other exciting development projects. To realize Bizzarrini's concept drawings and sketches, Luis translated them into a 1/5 clay model which was then compared to the original 1/8 plastic model presented to Bizzarrini; and there was basically very little similarity in proportion or style. There were many designers that came from all parts of the world to work on the CAD (Computer Aided Design) part of the project.

Arthur Conan Doyle Essay

Discuss Sir Arthur Conan Doyle’s presentation of evil in the Hound of the Baskervilles  In some eyes, Doyle is the creator of Sherlock Holmes and the man who started the whole detective genre scene. However, my admiration for Doyle goes further than just enjoying Holmes’s latest escapade.  On a superficial level, Doyle uses powerful verbs and adjectives to create the evil atmosphere, and teamed up with the colourful writing of the background, he can simply and easily create a blanket of malice around the hound;  Ã¢â‚¬Å"There stood a foul thing, a great, black beast†¦Ã¢â‚¬ Ã‚  In my mind, the best way Doyle portrays evil is by adding a touch of verisimilitude to his novel. â€Å"Of course, I’ve heard of the hound ever since I was in the nursery. It’s the pet story of the family, though I never thought of taking it seriously before.†Ã‚  Here, by adding a history to the hound, Doyle gave an unbelievable beast a sense of authenticity.  Doyle can contribute to the ‘believability factor’ in other ways;  Ã¢â‚¬Å"From this point onwards I will follow the course of events by transcribing my own letters to Mr Sherlock Holmes which lie before me on the table.†Ã‚  This is an excellent example of how Doyle can make a fictional character recite a fictional event, and still have it sound as if it is a factual account.  The weather is another method employed by Doyle to give the novel realism. â€Å"October 16th – A dull and foggy day, with a drizzle of rain. The house is banked in with rolling clouds, which rise now and then to show the dreary curves of the moor, with thin, silver veins upon the sides of the hills, and the distant boulders gleaming where the light strikes upon their wet faces†Ã‚  Here, instead of going into the character’s actions, Doyle goes into great detail about the surroundings, to add to the authenticity of the proceeding actions. More specifically about the bleak weather, the malevolence of the hound is easier to comprehend because of the desolate backdrop of the Moors.  Moving away from the idea of the weather being used to create realism, I can see a more important part the weather plays in the novel. Doyle uses the weather so extensively throughout the narrative you could say that the weather is a character in its own right. Doyle’s use of patheticfallacy helps to convey the character’s feelings of terror towards the evil of the hound, which combined with points I mentioned previously, help to improve the impact of the, in comparison, small matter of a large dog.  Ã¢â‚¬ËœDiscuss the presentation of evil in the Hound of the Baskervilles’ is a difficult question to answer. That’s why I thought it best to go to the hound itself;  Ã¢â‚¬Å"Or a spectral hound, black, silent, and monstrous?†Ã‚  The hound is expressed as a satanic manifestation, a beast with no hope, no scruples. It symbolises the greed and evil harboured in men, and what could be unleashed if the thin veneer of morality, which protects us from our own desires, was breached. You could even go as far as to say that the beast is Doyle’s representation of the darker side of capitalism. The beast is also a symbol of how fear can be use against people, and how people can be led to believe the unbelievable;  Ã¢â‚¬Å"To do so would be to descend to the level of these poor peasants who are not content with a mere fiend dog, but must needs describe him with hell-fire shooting from his mouth and eyes.†Ã‚  As touched on previously, this story can be read simply by fans of the Sherlock Holmes trilogy and the simply put evil references on the surface of the novel can act in as good as a way as the deeper points. Also the pace of action is a simple writer’s trick to help boost the presentation of the subject. For example, Doyle uses fast snappy sentences, such as ‘gaunt, savage and as large as a small lioness’, to speed up the action, and he uses long and complex sentences to allow the reader to reflect on the previous action. They are also used to allow the reader to start to solve the mystery in their own head. Another point of interest for me is the idea of a tragedy, the main tragedy of course being Stapleton. The thought that Stapleton could have been a good and loyal friend to Sir Charles Baskerville, but then turned to the greed in his own heart of the possible inheritance, is what constitutes a real tragedy.  To conclude, there are many ways in which Doyle portrays evil through his writing, be they the beast, the realism developed or the simple good versus evil. However, I have also found that none of the methods can stand alone, and that they all compliment each other in the rich diversity that is the Hound of The Baskervilles. William Shakespeare often compares imagination and reality in his plays. He explores this comparison through the role and purpose of the forests in Midsummer Nights Dream and As You Like It. Midsummer Nights Dream focuses on imagination and escape, while As You like It focuses on reality and self discovery. The forest in Midsummer Nights Dream represents imagination. Puck, a fairy servant and friend of Oberon, watches six Athenian men practice a play to be performed for Theseus wedding in the forest. Puck turns Nick Bottoms head into that of an ass.
